APPEL A TÉMOIN

15 Mars 2014

Parce-que vos accusations, tout comme vos conditions et vos lois, qu'elles soient spéciales ou non, sont et seront toujours injustes et illégitimes;

Parce-qu'elles sont basés sur une définition de la Justice qui est totalement archaïque et seront toujours antidémocratiques et liberticides;

Kidnapped by police in Bolivia, the RCMP does nothing to help victim

(If you want more information on this case, please contact COBP: cobp@riseup.net)

On Sept 11th 1990 I was kidnapped, illegally detained and charged with false drug charges by Bolivian police officers that were actually going to take me to Miami USA to kill me and then disguise the murder in a self defense accident. I was six week pregnant at the time!

The reason why they were going to do this is that I had been leading an 18 months solitary social fight to have my motherly rights respected and I was gaining a lot of notoriety. I wanted to get my two children back. Lucas was 6 years old and Yannick 2 years old. They had been kidnapped by my ex in laws one day that I went to work. I had appealed to the Canadian Consulate many times to be told this was a civil matter and they could not intervene to have my rights respected. I was totally mistreated in the tribunals and my in laws used all their social, political influence and money to get their way.

I manifested in front of Congress and the Government Palace and organized a manifestation in Plaza Murillo. Every weekend I would distribute my plight’s story to people on the Prado or in Calacoto with flyers. I had been interviewed on popular radio and TV channels but censured in most other Medias because of my in laws’ influence.

My ex parents in law paid for the illegal deportation with a check ($ 250 000) and a two week vacation for the officers and their mistresses had been reserved in a sea side hotel in Miami.
There was no tickets to Montreal or Ottawa or any other city in Canada even if the Bolivian Officers had contacted the RCMP to advise them of my deportation to Canada, something that should have awakened the RCMP’s curiosity since there exists no extradition contracts between Bolivia and Canada. The RCMP should have intervened and investigated better but it didn’t because the officer in charge happened to be someone that had a grudge against my brothers and me because he had asked me many years ago to act as a undercover to arrest some people that my very young brothers were doing business with at the time… but that I was not involved with. Something I had totally refused to do!!!

Luckily because of the integrity of one police officer… the whole deportation plan failed 10 minutes before the plane took off. Following this there was a huge outburst of articles in the press and on TV and even a parliamentary commission investigated my case. The authorities promised that the guilty would go to court and pay for their crime but it never happened.
Since some authorities in the government had been involved… The Bolivian Govt just played the game while there was a lot of coverage from the Medias but as soon as other news took over…they started to delay the case horribly.

I even had a petition signed by 33 deputies and the heads of all the local and international humanitarian associations that asked the judge to do me justice but even if this judge was a woman and a mother, she did not. She gave the custody of my children to my mother in law because my father in law gave her son a job in his bank.

Just weeks before the kidnapping I had been granted permanent employee status by United Nations which I found out later gave me diplomatic immunity. But United Nations seeing the scandal… made that contract disappear. The person that had traveled to Bolivia to make me sign it came back telling me he would testify in court if I wanted to initiate legal action against them for that but at that time with the pregnancy and all the other court cases I was already overload and had also lost some faith as if I would see my kids again since my visiting rights with them were not respected and the judge ignored my request with strategies like moving the court case from one office to the next all the time.

The fight went on for four years after that date and I did not see my children all that time. I also appealed to the Canadian Embassy in Lima to get some interaction which served nothing.
The Canadian Govt also did not do anything because of the misbehavior of the RCMP. After 4 years, it is when I discovered that my passport was missing from the court documents that magically appeared someone to “negotiate”: Colonel Antonio Arguedas… I was asked to give up all legal suits in exchange to be able to see my kids….something which as a mother I did especially since 4 years of legal fights had produced NOTHING!

When I returned to Canada in 1999 I asked the Ministry. of Information for the copies of the documents regarding the case. As soon as I did that my phone was tapped and my internet also and I was followed by some undercover agents.

When I called the RCMP to get a copy of the information they had on my case I was given a really bad and unjust treatment. Then one anonymous officer called me to tell me the true story.

I then wrote asking the RCMP if it was true… they never responded and as the anonymous officer had told me… this would happen if what I said was true for they would not respond lies in a letter. This would incriminate them.

On February 24th 2000, Colonel Antonio Arguedas, the “negotiator” of my social and legal plight EXPLODED in La Paz. He had been also the leader of the commando that killed Che Guevara and the one that took the hands and diary of Che Guevara to Fidel Castro.
On the night that he exploded I got a phone call from my ex-husband who told me Arguedas had exploded because he was writing a book… then he hanged up on me! I took this as a personal death threat since Arguedas had protected my author’s right in the negotiation… something he told me after we had signed the agreement.

I became a widow the year after… my other children being very young I decide to hold silence until they were adults.

A few years ago I denounced the sexual abuse my sister and I were victims of by the priest of Rigaud’s College Bourget. I also denounced the abuse my father had been victim of and that he took to his grave. I promised that day that I would not take my own personal story of total abuse from some corrupt policemen who were willing to kill a pregnant woman for 250 000 $ acted under the orders of the Bolivian DEA Chief Gonzalo Torrico who was raising funds to institute Bolivian Drug Laboratories.

At the time I was kidnapped there were 32 kidnapping during that period. Gonzalo Torrico was Chief of the Bolivian DEA. A few years later he became Honorary Consul of Honduras and with his diplomatic status started to import acetone into Bolivia to feed the drug labs. The Govt of USA published in the newspaper in Bolivia that they were taking away his visa and were going to prosecute him but it never happened.

Today Gonzalo Torrico is Honorary Consul of Malta, a Mediterranean country. Right after my kidnapping I was summoned to his office with my lawyer and he ordered I sign some documents that thanked him for helping to resolve my kidnapping (and attempted murder) but actually he was the one that ordered it! When my lawyer said to me in the car “Do you want your child to be born???” It was no joke… he meant it!

I want this story to be published… with the title… “Now I opened my big mouth… and said the truth… Kill me if you want! That will be the confirmation of the truth I spoke!!!!!!”

The other two officers that were conducting the Commando Operation were Colonel Nicolas Anaya… he went to jail for Traffic of Narcotics a few years later and Major Gonzalo Barba was suspended from his functions for health purposes.

*****english follow*****

---------------------------------------------------------------------------------------------------

Let me set the scene: me and 10 other professional circus performers received government funding to travel to Huancavelica in Perou to teach impoverished children our craft. The airline we used for our travels was Aero Mexico.
The nightmare began on our return trip. I took a pregnancy test 3 days before our return trip back home.. Turns out, I passed the test. I was pregnant. Unfortunately, while aboard the 6 hour flight from Perou to Mexico, I suffered a miscarriage. The plane had safely landed in Mexico, where I had to do a stop over for 12h before the next flight, and I was still confined to the tiny plane lavatories, painfully doubled over in pain because of my spontaneous abortion. The flight attendant was aware of the situation, and allowed my friend and I to exit the plane first. She promised I would be given a wheelchair once I entered the airport. Sadly, the wheelchair wasn’t there. Every step was sending shooting pains all throughout my body, excruciating pain I’d never experienced before. The walk to customs seemed interminable.
After what seemed like days, we finally arrived at customs. At this point, I had started bleeding profusely. Blood was running down my legs, and I was feeling really faint. The flight attendant asked to put me at the front of the line, so I could see a doctor as soon as humanly possible. The customs officer glances at me with disdain, and is completely indifferent to the flight attendant’s urgent pleas. Instead of showing us common human decency, he aggressively searches through both our bags. He shows absolutely no concern, and even more than that, seems to be mocking my pain.
We finally emerge from customs, still with no wheelchair. Our group of 5 are reunited. After suffering through several hours of unbearable pain, I’m starting to feel extremely light-headed. The abdominal pain is exponential, and I tell my friends that I need to lay down or I’d surely pass out right then and there. We find a small store inside the airport, and my friends lower me down on the couch located inside. I don’t have more than a minute to collect my strength when a dozen national police arrive, accompanied by a doctor. After examination, the doctor approves me for air travel, under the condition that I immediately visit a doctor upon my return to Canada. Knowing the pain I was under, he also prescribes some pain killers to make the trip back home bearable.
In order to fill the prescription, the doctor directs my friends to a pharmacy located one minute away from the airport on foot. My friends leave almost immediately with the prescription in hand. Unfortunately, the prescription we were given was a controlled substance in Mexico because of rampant recreational use. It was almost impossible to fill the prescription, and they had to search for over 2 and a half hour to finally find a small pharmacy at the opposite of the town, who would accept to fill the slip.
During the entire 12 hour layover in Mexico, my friends searched desperately for a wheelchair to no avail. We went to our airline company’s counter to ask for the wheelchair that was promised to us, and they told us that none were available. When we said that we saw tons of wheelchairs around the terminal, they told us those were for emergencies only. I really wonder what kind of airline doesn’t consider a woman having a miscarriage an emergency. What IS an emergency then? Some would feign interest in our problem, and would go through the motions of helping us, only to disappear 2 minutes later. Finally, my friends settled with a baggage trolley to cart me around. However, the metal bar was placed in such a way that it was bumping against my vagina causing me even more agonizing pain.
The departure for our flight back to Montreal was fast approaching, so we head to the gate. Surprisingly, we finally got a wheelchair! We only had to argue with the staff for 2 hours at the terminal for it and had to return it almost immediately. We board the plane and head to our assigned seats. Once in our seats, we could almost breathe a sigh of relief. We were heading home, and this traumatizing ordeal was almost over. Before we had a chance to get too comfortable, several police officers boarded the plane and demanded to see the doctor’s note. I hand them the note, and the police bring it to the pilot. Even though the doctor had decreed that I was healthy enough to fly, the pilot decides the paper is invalid and refuses to take off if I remained onboard. They tell me that for my own sake, I must remain grounded. I start crying hysterically, begging to be brought home and that I could withstand a short 4 hour flight if it meant I could finally be treated at home. The pain killers had taken effect, and the pain was completely bearable. Just knowing that I’d be home helped calm me down, and I desperately just wanted this to be over. While I was pleading my case, the police began to physically push me off the plane. As I was leaving, the flight attendant informs me not to worry, that I could board the next flight and it would be completely free. I asked them to then explain why if I was well enough to board the very next flight, why couldn’t I board this one? I didn’t receive an answer, and I was pushed off the flight.
Two of my friends voluntarily exited the plane, not wanting to abandon me in a foreign country in the middle of the night by myself in my current state. Sadly, since they left the plane voluntarily, their ticket would not be refunded. Since they wanted to take care of their friend who had just suffered a miscarriage only hours earlier, and was kicked off her flight home, they’d have to pay for another ticket out of their own pockets. Here we are, standing in the Mexican airport, without our luggage, without any information on what to do from here, and watching our flight to Montreal leave us in the dust. More police officers arrive, and start pushing us away, shouting that we had no business standing here. We ask them where we should be heading, because we sincerely didn’t know. Our questions are met with silence, with the pushing getting more urgent. As the police are leading us down the terminal, airport security approaches us and begins to pull us in the opposite direction saying that we should be headed this way. Just a reminder, as the police and airport security are squabbling over where to take us, and pulling us in every which way, I’m STILL without a wheelchair and my pain is making its presence felt.
So here I am. Stuck in Mexico without any money, with absolitely no idea where my luggage has ended up, without a wheelchair and in throbbing pain. After aimlessly looking for a solution to any one of the previously mentioned problems, an altruistic security guard takes it upon himself to help up. He finds out that they had the time to remove all of our luggage from the plane, except for one of our friends stuff which had been brought to Montreal. Two hours, and two body searches later, we are reunited with our luggage.......only to find out they removed someone else’s luggage from the plane. So we were left with absolutely nothing. Well, we can at least head to the airline companie’s counter to reserve our seats for the next flight. But since it’s the middle of the night, it’s CLOSED! Obviously. Oh yeah, by the way : still no wheelchair.
We waited patiently for the counter to reopen. The only flight back to Montreal is in 24 hours from now. I can’t believe that I’ll have to spend another full 24 hours, having just suffered through hell and back, and I’ll still be unable to return home and seek treatment for another full day. Powerless to change a thing, I explain the situation and that I was promised that my seat on the next available flight would be free. He refuses to give me a free seat, and demands I pay full price for my ticket if I want to fly home. On top of everything, the doctor’s note that allowed me to fly in my current state was only valid for THAT particular flight. I would have to find another doctor, who would need to re-examine me and approve me for air travel for THIS flight. So now, not only am I stuck in Mexico for another full day, but now I don’t have a dime and I have to find the funds to buy another flight back home. And we have suitcases that don’t even belong to us. Things are not looking up, and I’m having a full blown panic attack.
We park ourselves in a cafe and start making some emergency calls. I call both my boyfriend and my good friend, telling them that all three of us are stuck in Mexico without any money, and completely desperate. Even if there was a way out, we barely have any energy to stand up let alone figure out a way out of this. My boyfriend spends hours on the phone with the Canadian Embassy to no avail, while my friend tries to comfort me, assuring me that they’ll get me out of this. Finally, they managed to find room on an Air Canada flight leaving from another section of the airport that was a 10 minute bus ride away.
We confirmed our seats on the flight and, with a bit of renewed hope, we head towards the gate. We arrive at Air Canada at around 630 in the morning. At the check-in, the woman asks for our immigration papers. Sadly, when we were unceremoniously kicked off the flight, they never returned our immigration papers. We would have to redo them completely, but the office opens at 7am, and the last boarding call for the flight ends at 7. Faced with the possibility that we might miss yet another flight, and be stranded here even longer, we start panicking. We plead with the attendant that we cannot bear another delay, and that my health might really depend on returning home. She seems to empathize with our plight, and manages to delay the flight for half an hour so that we’d be able to board. We have to pay exceptionally high baggage fees, since on our original airline we had the right to two bags, but on Air Canada we only have the right to one.
We arrive at the immigration offices and are met with a HUGE line up. We speak to every single person in front of us, and in a show of human kindness, we manage to get to the front of the line. Our papers ended up costing us a couple hundred dollars, and we made it to the gate with only 2 minutes to spare. One three hour connection in Toronto, and finally arrived home.
What was supposed to be a 24 hour trip, with only one connection ended up being a 60 hour nightmare with two connections. I’ve been dealing with post-traumatic stress ever since. I usually can’t sleep, and when I do, I’m haunted by nightmares all night. Im always waking in a start, covered in a cold sweat. I can’t shake the feeling, cant seem to forget the experience. All in all, this cost us thousands of dollars just to be able to leave Mexico, but it’s cost me so much more personally. I’ve spoken to my lawyer, the Honorable Franccesca Cancino, who promised to champion my case and with the appropriate media attention behind it, but that I had to be supported by the appropriate human rights groups in order to have a shot. Suing them would cost me in the upwards of 15 thousand dollars. So, I’m humbly asking for your help. I cannot let this slide. I can’t let them win this one. Because of this, I was unable to pay my rent. My friends were also financially crippled because they stood by my side. I find it completely abhorrent that I was ejected from an airplane, that a medical note was invalidated and I was grounded though given no real medical assistance while on the ground. In fact, being grounded in Mexico made my health considerably worse. I’ve contacted the Human Rights Comission, but they responded that it was not in their jurisdiction.

Here is a tally of our expenses:

+ 3 plane tickets: 1000$ + Luggage fees: 100$ + Immigration Papers: 100$ + International Emergency Phone Call: 250$ + Additional Travel and Medical Costs: 50$

And I need 15 000$ to bring the company in Court

Thanks for listening to my cry for help.
