RCMP officer who asked witness if her breasts were real found guilty of breach of trust

RED DEER—A judge called the actions of a former Red Deer, Alta., RCMP officer “predatory,” finding him guilty of a charge of breach of trust for asking a witness if her “nice breasts” were “real or fake” while he was investigating a domestic dispute in 2016.

Justice David Gates said Tuesday that while he did not believe Jason Tress’ actions rose to the level of criminal sexual assault while carrying a weapon, he made it clear “this was not casual or innocent flirtation,” finding the former Mountie isolated the witness in a bedroom “clearly for a sexual purpose, specifically for the accused’s sexual gratification.”

According to an agreed statement of facts, the victim — who cannot be named because of a court-ordered publication ban — called police for help in the early morning hours of May 1, 2016, after a fight between her two friends turned violent.
