Voici ma déclaration par rapport à ce qui m'est arrivé au Mexique. Je demande l'aide de la population j'ai besoin d'appui d'organisme pour éventuellement faire une mise en demeure contre la compagnie aérienne. Je suis à boutte d'énergie et je ne sais pas ou dois-je me diriger. Merci de faire spinner et si vous avez des ressources à me conseiller cela serait grandement apprécier. merci

TÉMOIGNAGE DE L'ÉVÈNEMENT DU 1ER OCTOBRE – MEXICO CITY

Voici la situation de départ juste pour vous mettre dans le contexte : Moi et 10 autres artistes de cirque avons obtenus une subvention gouvernementale pour aller enseigner le cirque aux enfants pauvres pendant deux semaines dans la ville de Huancavelica, Pérou. La compagnie aérienne que nous avons utilisée est Aéro Mexico.

L'histoire :

Ceci s'est passé pendant le chemin du retour.... j'ai faite un test de grossesse 3 jours avant de prendre l'avion pour le retour et qui s'est avérée être positif. Dans l'avion du Pérou jusqu'au Mexique (il y avait une escale de 12h à l'aéroport de Mexico city), j'ai faite une fausse couche dans les airs vers la fin du vol. Arrivée au Mexique j'étais encore dans les toilettes de l'avion entrain de faire cette fausse couche. L'hôtesse de l'air, étant au courant, m'a faite sortir en premier de l'avion avec une amie qui m'accompagnait. Ils m'avaient promis que j'aurais accès à une chaise roulante à mon arrivée, chose qui ne s'est pas produite donc j'ai dû traîner mon corps en douleur extrême et marcher. Rendue aux douanes mexicaines, j'étais en grosses douleurs et je continuais à saigner abondamment, du sang coulait le long de mes jambes. L'hôtesse de l'air demande au douanier de me laisser passer les douanes en urgence car je dois voir un médecin le plus vite possible. Le douanier me regarde, se fou carrément de ce qu'elle vient de dire et se met à fouiller les bagages de mon amie en me lançant des regards de haine pour être certain que je suis bien douleur.

Finalement 1h plus tard je me retrouve dehors avec mon amie, toujours sans chaise roulante. Nous étions au retour un groupe de 5 personnes. Je me sentais très faible, ma tête tournait et j'avais des énormes crampes dans mes ovaires. J'avais besoin de m'étendre car je sentais que j'allais tomber sans connaissance alors nous avons trouver un sofa dans un petit magasin à l'aéroport pour que puisse m'étendre. Soudainement une dizaine de polices nationales sont arrivées avec le médecin au magasin. Ils m'amènent voir le médecin de l'aéroport. Le médecin a faite une analyse de mon bilan de santé et m'a faite signer une décharge comme quoi j'étais apte à prendre l'avion pour retourner à Montréal mais suggérais sur le papier de voir un médecin rendu chez moi.

Le médecin m'avait prescrit des pilules anti-douleur et a affirmé que la pharmacie se trouvait à une minute de marche de l'aéroport. Deux de mes amis sont alors partis chercher ce médicament. Finalement cela a pris plus de 2h30 car le médicament prescrit est un médicament que les drogués au Mexique utilise pour se défoncer, alors impossible à trouver en pharmacie. Ils ont dû parcourir Mexico dans les autobus et métros pour finalement trouver le médicament à l'autre bout de la ville dans une petite pharmacie.

Pendant ce 12 heures d'escales, mes amis ont tentés désespérement de me trouver une chaise roulante sans succès. On s'est pointé plusieurs fois au département de la compagnie aérienne pour réclamer une chaise roulante et ils ont dit tout ce temps qu'il n'y avait pas de chaises roulante disponible... que ceux que nous voyions traîner dans le département était gardées en cas d'urgence...même si cette situation était une urgence. On avait beau leurs expliquer ce qui était arrivé ils s'en foutaient, faisaient semblant de nous aider et disparaissaient 2 minutes plus tard et ne revenaient pas. Finalement pendant une journée complète mes amis m'ont traîner dans un chariot pour transporter les bagages, en acier qui frottait sur mon vagin qui me créait des douleurs extrêmes.

Rendu au moment du vol de Montréal, cela nous a pris 2h pour finalement obtenir une chaise roulante pour une très courte durée.... car la compagnie nous avait promis une chaise roulante prête pour moi pour 23h....chose qui n'est pas arrivé et nous avons dû argumenter pendant 2h avec la compagnie pour finalement en avoir une. Dans l'avion, nous nous dirigeons vers nos places assignés dans l'avion. Nous étions tous assis, on commençait à respirer en se disant que ce cauchemar est terminée quand soudainement plein de polices nationales sont entrés dans l'avion et ont demandés à voir le papier du médecin. Il était alors 1h30 du matin. Nous montrons ce papier, le prennent et l'amènent au pilote. Le pilote décide que le papier signé du médecin n'est pas valide et il décide de ne pas décoller tant et aussi longtemps que je suis dans l'avion. Ils disent que je dois quitter l'avion pour ma santé. Je commence à paniquer et pleurer en expliquant que j'ai besoin de rentrer chez moi et que le vol ne dure que 4h. J'avais déjà commencer à me sentir un peu mieux justement parce que je savais que je rentrais dans mon pays. Une des polices a alors commencer à me tirer physiquement en dehors de l'avion. L'hôtesse de l'air me confirme que mon billet d'avion va être changé gratuitement pour le prochain vol. Mais j'avais beau leur demander pourquoi je suis jetée en dehors de l'avion et personne ne me répondais

Rendue à l'extérieur de l'avion, deux de mes amis ont décidé de quitter volontairement l'avion pour ne pas me laisser seule en plein milieu de la nuit au Mexique, mais que eux devront débourser de leurs poches un autre billet d'avion. Bref, nous sommes trois à l'extérieur de l'avion, ils ferment les portes, l'avion décolle, et tout le monde s'en va en nous abandonnant comme des merdes. Nous n'avons aucunes informations à savoir ou sont nos bagages, comment changer nos billets, ou nous devons aller etc.... bref une fois jetés en dehors de l'avion aucune aide nous a été apporté et nous avons été complètement laisser à l'abandon. Deux polices arrivent alors et commencent à nous pousser dans une direction en disant qu'on a pas d'affaire ici... on a beau demander cest ou qu'on doit aller ils refusent de nous répondre. Soudainement un gardien de sécurité arrive dans le sens opposé et nous dit qu'on peux pas aller là et commence à nous diriger dans l'autre sens pendant que les deux polices continuent à vouloir nous faire aller dans la direction qu'ils veulent. Juste mentionner que pendant tout ce temps je n'ai toujours pas accès à une chaise roulante et je suis en douleur.

Alors me voilà bloquée au Mexique sans argent, sans savoir ou sont mes valises et en douleur. Finalement un gardien de sécurité de l'aéroport décide de nous aider. Une heure plus tard nous apprenons que nos bagages ont été enlevés de l'avion sauf pour une personne que ses bagages ont décollés pour Montréal. Nous retrouvons finalement nos bagages deux heures plus tard, après une seconde fouille et pour finalement réaliser qu'ils ont décharger des bagages qui ne nous appartiennent pas. Nous nous dirigeons au comptoir de la compagnie aérienne et évidement c'était fermé on est en plein milieu de la nuit... toujours pas accès à une chaise roulante. Nous avons attendu que le comptoir ouvre, nous nous sommes dirigés vers eux en expliquant la situation. Le monsieur du comptoir refuse de changer mon billet gratuitement. Il dit que nous devons acheter un autre billet de notre poche pour le vol qui décolle 24h plus tard! Et que mon papier du médecin n'est pas valide que je dois aller à l'hôpital pour avoir un second papier du médecin m'autorisant à prendre l'avion. Alors me voilà bloquée de la compagnie aérienne. Là nous commençons à paniquer il est 4h du matin et aucunes possibilités d'utiliser cette compagnie aérienne, sans argent et avec des bagages qui ne nous appartiennent pas.

Alors nous allons nous poser dans un café et j'ai appelé mon ami et mon copain au Canada en leur disant que nous sommes 3 personnes bloquées de force au Mexique sans argent et sans énergie. Mon copain a passer une heure au téléphone avec l'ambassade du Canada sans succès pendant que mon ami me parle au téléphone pour me rassurer qu'il va nous sortir de cette merde. Cela a été très dur de trouver une autre compagnie aérienne pour revenir. Finalement nous avons trouver dernière minute la compagnie Air Canada qui partait d'un autre département de l'aéroport situé à 10 minutes d'autobus.

Nous confirmons les billets d'avions et nous nous précipitons vers l'autobus qui a été long à trouver pour se diriger vers la nouvelle compagnie. Nous sommes arrivés à Air Canada à 6h30 du matin. Au check in la madame nous demande nos papiers de migrations. Évidemment nous ne les avons plus car Aéro Mexico nous les ont pris sans nous les redonner. Elle dit alors que nous ne pouvons pas prendre l'avion, que nous devons aller refaire nos papiers de migrations mais que le bureau ouvre à 7h et que le check in ferme à 7h. Nous recommençons à paniquer en exigeant à parler à son superviseur. Il arrive nous expliquons la situation et nous dit que exceptionnellement il va attendre jusqu'à 7h30 pour fermer le check in. Nous enregistrons nos bagages mais nous avons dû payer un gros montant pour les bagages excédant car avec Air Canada nous avions droit qu'à un bagage tandis que avec Aéro Mexico nous avions droit à deux bagages.

Bref nous courons jusqu'au bureau de migration en réalisant qu'il y a un gros line up. Nous nous mettons à parler avec chaque personne pour passer devant eux. Finalement on a passer en premier, cela nous a coûter une centaine de dollars pour refaire nos papiers et nous sommes arrivés au check 2 minutes avant que cela ferme. Nous avons dû faire en plus une escale de 3h à Toronto.

En tout mon retour qui était sensé durer 24h avec une escale s'est ramassé à deux jours et demie avec deux escales. Je juge que j'ai subi un traitement inhumain de la part de la compagnie aérienne, j'ai un troma psychologique depuis, je n'arrive pas à dormir et je fais des cauchemars. En tout cela a coûter au-dessus de 1000$ être bloquée sans raison valable au Mexique. J'ai consulté plusieurs avocats qui sont prêts à me faire une mise en demeure avec sortie médiatique mais elle m'expliquait que je devais avoir un bon back up d'organisme pour que la mise en demeure aille du poids. Alors je vous sollicite votre aide car je ne veux pas laisser ça passer. Je ne peux pas payer mon loyer à cause de ça, je suis sans-emploi et je trouve inhumain le fait de m'avoir faite jetée en dehors de l'avion même avec une décharge et de ne pas avoir reçu aucune aide quelconque...à voir même le contraire.

Une semaine plus tard je me réveille constamment en sursaut, je fais des cauchemars sans arrêt et je vis un trauma psychologique. J'ai contacté la Comission des droits de la personne mais m'ont répondu que ce n'est pas dans leur jurisprudence.

Dépenses que nous avons dû faire :

Poursuite au civil (que j'aimerais entamer): 15 000$
3 billets d'avions = 1000$
excedant de bagages = 100$
refaire papiers de migrations  = 100$
bill de téléphone pour avoir appelé ici pour se faire sauver la peau = 250$
autobus pour changer d'aéroport = 50$

Let me set the scene: me and 10 other professional circus performers received government funding to travel to Huancavelica in Perou to teach impoverished children our craft. The airline we used for our travels was Aero Mexico.
The nightmare began on our return trip. I took a pregnancy test 3 days before our return trip back home.. Turns out, I passed the test. I was pregnant. Unfortunately, while aboard the 6 hour flight from Perou to Mexico, I suffered a miscarriage. The plane had safely landed in Mexico, where I had to do a stop over for 12h before the next flight, and I was still confined to the tiny plane lavatories, painfully doubled over in pain because of my spontaneous abortion. The flight attendant was aware of the situation, and allowed my friend and I to exit the plane first. She promised I would be given a wheelchair once I entered the airport. Sadly, the wheelchair wasn’t there. Every step was sending shooting pains all throughout my body, excruciating pain I’d never experienced before. The walk to customs seemed interminable.
After what seemed like days, we finally arrived at customs. At this point, I had started bleeding profusely. Blood was running down my legs, and I was feeling really faint. The flight attendant asked to put me at the front of the line, so I could see a doctor as soon as humanly possible. The customs officer glances at me with disdain, and is completely indifferent to the flight attendant’s urgent pleas. Instead of showing us common human decency, he aggressively searches through both our bags. He shows absolutely no concern, and even more than that, seems to be mocking my pain.
We finally emerge from customs, still with no wheelchair. Our group of 5 are reunited. After suffering through several hours of unbearable pain, I’m starting to feel extremely light-headed. The abdominal pain is exponential, and I tell my friends that I need to lay down or I’d surely pass out right then and there. We find a small store inside the airport, and my friends lower me down on the couch located inside. I don’t have more than a minute to collect my strength when a dozen national police arrive, accompanied by a doctor. After examination, the doctor approves me for air travel, under the condition that I immediately visit a doctor upon my return to Canada. Knowing the pain I was under, he also prescribes some pain killers to make the trip back home bearable.
In order to fill the prescription, the doctor directs my friends to a pharmacy located one minute away from the airport on foot. My friends leave almost immediately with the prescription in hand. Unfortunately, the prescription we were given was a controlled substance in Mexico because of rampant recreational use. It was almost impossible to fill the prescription, and they had to search for over 2 and a half hour to finally find a small pharmacy at the opposite of the town, who would accept to fill the slip.
During the entire 12 hour layover in Mexico, my friends searched desperately for a wheelchair to no avail. We went to our airline company’s counter to ask for the wheelchair that was promised to us, and they told us that none were available. When we said that we saw tons of wheelchairs around the terminal, they told us those were for emergencies only. I really wonder what kind of airline doesn’t consider a woman having a miscarriage an emergency. What IS an emergency then? Some would feign interest in our problem, and would go through the motions of helping us, only to disappear 2 minutes later. Finally, my friends settled with a baggage trolley to cart me around. However, the metal bar was placed in such a way that it was bumping against my vagina causing me even more agonizing pain.
The departure for our flight back to Montreal was fast approaching, so we head to the gate. Surprisingly, we finally got a wheelchair! We only had to argue with the staff for 2 hours at the terminal for it and had to return it almost immediately. We board the plane and head to our assigned seats. Once in our seats, we could almost breathe a sigh of relief. We were heading home, and this traumatizing ordeal was almost over. Before we had a chance to get too comfortable, several police officers boarded the plane and demanded to see the doctor’s note. I hand them the note, and the police bring it to the pilot. Even though the doctor had decreed that I was healthy enough to fly, the pilot decides the paper is invalid and refuses to take off if I remained onboard. They tell me that for my own sake, I must remain grounded. I start crying hysterically, begging to be brought home and that I could withstand a short 4 hour flight if it meant I could finally be treated at home. The pain killers had taken effect, and the pain was completely bearable. Just knowing that I’d be home helped calm me down, and I desperately just wanted this to be over. While I was pleading my case, the police began to physically push me off the plane. As I was leaving, the flight attendant informs me not to worry, that I could board the next flight and it would be completely free. I asked them to then explain why if I was well enough to board the very next flight, why couldn’t I board this one? I didn’t receive an answer, and I was pushed off the flight.
Two of my friends voluntarily exited the plane, not wanting to abandon me in a foreign country in the middle of the night by myself in my current state. Sadly, since they left the plane voluntarily, their ticket would not be refunded. Since they wanted to take care of their friend who had just suffered a miscarriage only hours earlier, and was kicked off her flight home, they’d have to pay for another ticket out of their own pockets. Here we are, standing in the Mexican airport, without our luggage, without any information on what to do from here, and watching our flight to Montreal leave us in the dust. More police officers arrive, and start pushing us away, shouting that we had no business standing here. We ask them where we should be heading, because we sincerely didn’t know. Our questions are met with silence, with the pushing getting more urgent. As the police are leading us down the terminal, airport security approaches us and begins to pull us in the opposite direction saying that we should be headed this way. Just a reminder, as the police and airport security are squabbling over where to take us, and pulling us in every which way, I’m STILL without a wheelchair and my pain is making its presence felt.
So here I am. Stuck in Mexico without any money, with absolitely no idea where my luggage has ended up, without a wheelchair and in throbbing pain. After aimlessly looking for a solution to any one of the previously mentioned problems, an altruistic security guard takes it upon himself to help up. He finds out that they had the time to remove all of our luggage from the plane, except for one of our friends stuff which had been brought to Montreal. Two hours, and two body searches later, we are reunited with our luggage.......only to find out they removed someone else’s luggage from the plane. So we were left with absolutely nothing. Well, we can at least head to the airline companie’s counter to reserve our seats for the next flight. But since it’s the middle of the night, it’s CLOSED! Obviously. Oh yeah, by the way : still no wheelchair.
We waited patiently for the counter to reopen. The only flight back to Montreal is in 24 hours from now. I can’t believe that I’ll have to spend another full 24 hours, having just suffered through hell and back, and I’ll still be unable to return home and seek treatment for another full day. Powerless to change a thing, I explain the situation and that I was promised that my seat on the next available flight would be free. He refuses to give me a free seat, and demands I pay full price for my ticket if I want to fly home. On top of everything, the doctor’s note that allowed me to fly in my current state was only valid for THAT particular flight. I would have to find another doctor, who would need to re-examine me and approve me for air travel for THIS flight. So now, not only am I stuck in Mexico for another full day, but now I don’t have a dime and I have to find the funds to buy another flight back home. And we have suitcases that don’t even belong to us. Things are not looking up, and I’m having a full blown panic attack.
We park ourselves in a cafe and start making some emergency calls. I call both my boyfriend and my good friend, telling them that all three of us are stuck in Mexico without any money, and completely desperate. Even if there was a way out, we barely have any energy to stand up let alone figure out a way out of this. My boyfriend spends hours on the phone with the Canadian Embassy to no avail, while my friend tries to comfort me, assuring me that they’ll get me out of this. Finally, they managed to find room on an Air Canada flight leaving from another section of the airport that was a 10 minute bus ride away.
We confirmed our seats on the flight and, with a bit of renewed hope, we head towards the gate. We arrive at Air Canada at around 630 in the morning. At the check-in, the woman asks for our immigration papers. Sadly, when we were unceremoniously kicked off the flight, they never returned our immigration papers. We would have to redo them completely, but the office opens at 7am, and the last boarding call for the flight ends at 7. Faced with the possibility that we might miss yet another flight, and be stranded here even longer, we start panicking. We plead with the attendant that we cannot bear another delay, and that my health might really depend on returning home. She seems to empathize with our plight, and manages to delay the flight for half an hour so that we’d be able to board. We have to pay exceptionally high baggage fees, since on our original airline we had the right to two bags, but on Air Canada we only have the right to one.
We arrive at the immigration offices and are met with a HUGE line up. We speak to every single person in front of us, and in a show of human kindness, we manage to get to the front of the line. Our papers ended up costing us a couple hundred dollars, and we made it to the gate with only 2 minutes to spare. One three hour connection in Toronto, and finally arrived home.
What was supposed to be a 24 hour trip, with only one connection ended up being a 60 hour nightmare with two connections. I’ve been dealing with post-traumatic stress ever since. I usually can’t sleep, and when I do, I’m haunted by nightmares all night. Im always waking in a start, covered in a cold sweat. I can’t shake the feeling, cant seem to forget the experience. All in all, this cost us thousands of dollars just to be able to leave Mexico, but it’s cost me so much more personally. I’ve spoken to my lawyer, the Honorable Franccesca Cancino, who promised to champion my case and with the appropriate media attention behind it, but that I had to be supported by the appropriate human rights groups in order to have a shot. Suing them would cost me in the upwards of 15 thousand dollars. So, I’m humbly asking for your help. I cannot let this slide. I can’t let them win this one. Because of this, I was unable to pay my rent. My friends were also financially crippled because they stood by my side. I find it completely abhorrent that I was ejected from an airplane, that a medical note was invalidated and I was grounded though given no real medical assistance while on the ground. In fact, being grounded in Mexico made my health considerably worse. I’ve contacted the Human Rights Comission, but they responded that it was not in their jurisdiction.

Here is a tally of our expenses:

+ 3 plane tickets: 1000$ + Luggage fees: 100$ + Immigration Papers: 100$ + International Emergency Phone Call: 250$ + Additional Travel and Medical Costs: 50$

And I need 15 000$ to bring the company in Court
