Un militant communautaire entreprend aujourd'hui de contester la constitutionnalité de la loi anti-manifestation P-6

Montréal, 22 novembre 2013 - Aujourd'hui à partir de 9h30 le militant communautaire Jaggi Singh entreprendra la contestation de la constitutionnalité du règlement anti-manifestation P-6 de Montréal. Singh a une audience "pro-forma" aujourd'hui à la Cour municipale de Montréal et il soumettra un avis écrit de contestation de constitutionnalité, tel que demandé par le juge Sophie Beauchemin.

Des milliers de manifestants ont été détenus et ont reçu des contraventions au cours de la dernière décennie en vertu du règlement montréalais P-6. Depuis mai 2012, d'autres centaines de manifestants ont été détenus et ont reçu des contraventions (et dans plusieurs cas emprisonnés) en vertu des nouvelles dispositions de P-6 qui ont permis de rehausser la première amende à plus de 600$, et qui pénalisent le refus de donner l'itinéraire des manifestations ou le port de masques.

Singh a reçu une contravention en vertu de P-6 le soir du 9 juin 2012, au centre-ville de Montréal, lors du Grand Prix. Sans avoir encore participé à une manifestation, il a été pourchassé par la police, arrêté, emprisonné, puis relâché avec une amende de 634$. Dix-sept mois plus tard, Singh a reçu sa première convocation en cours ce mercredi, face au juge Beauchemin de la cour municipale de Montréal. Il a réussi à obtenir un second pro-forma, aujourd'hui, pour essayer d'entreprendre le processus de contestation de la loi P-6.

"Ce n'est pas en Cour ni à l'Hôtel de ville que P-6 sera défait, mais dans la rue, à mesure que les groupes communautaires qui organisent des manifestations défieront le règlement P-6, et que la résistance au niveau de la rue la rendra inapplicable," a dit M. Singh.

Il ajoute: "Mais, si les policiers continuent d'émettre des contraventions P6, et si les avocats de la Ville maintiennent les accusations, tactiquement, la validité du règlement P-6 devra être contestée, tout comme le règlement montréalais contre l'affichage a été défié et renversé."

Singh est membre de plusieurs organisations -- QPIRG Concordia, Solidarité sans frontières, Personne n'est illégal et La Convergence des luttes anticapitalistes (CLAC) -- qui ont signé une déclaration contestant ouvertement le règlement P-6. Depuis la vague d'arrestations reliées à P-6 au cours de trois manifestations distinctes en mars 2013, plusieurs groupes communautaires ont ouvertement défié le règlement, incluant la marche "Un Statut pour tous et toutes" (18 mai 2013), la manifestation "À qui la ville" dans St-Henri (1er juin 2013), la manifestation "À qui la ville" dans Villeray (9 juin 2013), la marche "Ensemble contre la Charte xénophobe" (20 octobre 2013), la manifestation contre Stephen Harper (15 novembre 2013), la marche anti-austérité de l'ASSÉ (15 novembre 2013), et plusieurs autres protestations, grandes et petites. Alors que des douzaines de manifestations défiant P-6 n'ont reçu aucune contravention, deux manifestations organisées par la CLAC ont été ciblées pour des arrestations de masse et des contraventions, les 5 avril et 1er mai, 2013. Avec 400 autres, le 1er mai, Singh a été accusé en vertu de P-6. Il contestera aussi la constitutionnalité de cette amende.

NOVEMBER 22, 2013, MONTREAL -- Today at 9:30am, local community organizer Jaggi Singh will begin the process of starting a constitutional challenge to Montreal's anti-protest by-law P-6. Singh has a "pro forma" hearing today at Montreal's Municipal Court and he will provide written notice of the constitutional challenge as requested by Judge Sophie Beauchemin.

Thousands of demonstrators have been detained and ticketed in the past decade under Montreal's P-6 by-law. Since May 2012, hundreds more have been detained and ticketed (in many cases jailed) under new P-6 provisions which have raised first-time fines to more than $600, and penalizes the refusal to share demo routes or mask-wearing.

Singh was ticketed under P-6 on the evening of June 9, 2012 in downtown Montreal during the Montreal Grand Prix. He had not yet participated in a demonstration, but was chased by police, arrested, jailed, and eventually released with a $634 P-6 ticket. After waiting for more than 17 months, Singh had his first court date this past Wednesday in front of Judge Sophie Beauchemin at Montreal's Municipal Court. He succeeded in securing a second pro-forma, today, to begin the process of contesting the P-6 by-law.

"It's not in the courts or at City Hall that P-6 will be defeated, but in the streets, as community groups organizing demonstrations continue to openly defy the P-6 by-law, and make it inapplicable by street-level resistance," stated Singh.

He adds, "But, if the police continue to issue P-6 tickets, and if City lawyers continue to pursue charges, then tactically the very validity of the P-6 by-law should be challenged, just like Montreal's anti-postering by-law was challenged and overturned."

Since a wave of P-6 related arrests at three separate demonstrations in March 2013, several community groups have openly defied the P-6 by-law, including at the "Status For All" march (May 18, 2013) , the "À qui la ville" march in St-Henri (June 1, 2013), the "À qui la ville" march in Villeray (June 9, 2013), the "Ensemble contre la Charte xénophobe" demonstration (October 20, 2013), the Harper Mutiny demonstration (November 15, 2013), the anti-austerity march by ASSÉ (November 15, 2013), and many other protests, both large and small. While dozens of demos defying P-6 have not been ticketed, two CLAC-organized protests were targeted for mass arrests and tickets on April 5 & May 1, 2013. Along with 400 others, Singh was also charged under P-6 on May 1st, and will also challenge that ticket on constitutional grounds.
