Judge rejected request to dismiss police sex assault charges due to delay

When the trial for three Toronto police officers accused of sexually assaulting a parking enforcement officer begins Monday, it will be after a failed attempt to have the charges tossed due to delay.

The pretrial motions could not be reported on until the officers opted at the last-minute last week to have their case decided by a judge rather than a jury.

Leslie Nyznik, Joshua Cabero and Sameer Kara, all 51 Division officers, have each pleaded not guilty to a charge of sexual assault.

They are accused of sexually assaulting a woman in a downtown Toronto hotel room after a “rookie night” party on Jan. 16, 2015. The complainant told police she was in and out of consciousness during the alleged sexual assault and was unable to say no or move, according to court documents filed by the Crown in pretrial motions.
